The city of Philadelphia has filed a lawsuit against Elon Musk and his super PAC, accusing them of running an illegal lottery by offering $1 million daily giveaways to registered voters in swing states.

Let’s bring you up to speed: Earlier this month, Elon Musk and his super PAC, America PAC, launched daily million-dollar giveaways targeted at registered voters in swing states. To enter, voters must provide personal information, including their address, phone number, and email, and sign a petition pledging support for the First and Second Amendments. The PAC claims that winners are chosen randomly each day, with the initiative designed to boost voter engagement and rally support for Republican candidate Donald Trump in the presidential election. This move has prompted a warning from the Justice Department, which noted the giveaways could be illegal.

What’s going on now: Philadelphia District Attorney Larry Krasner announced a civil lawsuit against Elon Musk and his super PAC, America PAC, seeking to halt their $1 million daily giveaways to voters in swing states. Krasner argues that these giveaways constitute an illegal lottery under Pennsylvania law, which mandates that all lotteries be regulated by the state. In a press release, Krasner said, “The Philadelphia District Attorney is charged with protecting the public from public nuisances and unfair trade practices, including illegal lotteries. The DA is also charged with protecting the public from interference with the integrity of elections.”

In their lawsuit, the city wrote, “America PAC and Musk are lulling Philadelphia citizens – and others in the Commonwealth (and other swing states in the upcoming election) – to give up their personal identifying information and make a political pledge in exchange for the chance to win $1 million. That is a lottery. And it is indisputably an unlawful lottery.”

At the moment, Musk and America Pac have not commented on the lawsuit. More to come.
