Former President Donald Trump has asked for his sentencing in a New York criminal case to be postponed until after the 2024 presidential election.
What’s the deal: Trump’s legal team requested in court documents that his sentencing be postponed until after the 2024 presidential election. They argue that the current schedule leaves too little time between the judge’s upcoming decision on whether the recent Supreme Court ruling on presidential immunity affects Trump’s conviction and the sentencing date. The delay, they say, is necessary to give Trump enough time to consider and pursue potential state and federal appeals if they disagree with the judge’s ruling. The lawyers also stated, “We respectfully request that any sentencing, if necessary, be delayed until after the Presidential election.”
More on the case: Earlier this year, Trump was convicted on 34 counts of falsifying business records related to hush money payments made to adult film actress Stormy Daniels shortly before the 2016 presidential election. The $130,000 payments were allegedly made to prevent Daniels from going public with claims of an affair with Trump, which he denies. Prosecutors argued that Trump misrepresented these payments as legal expenses to hide damaging information from voters.
Trump’s claims: Trump has repeatedly claimed that the charges against him are politically motivated, arguing that the prosecution is an effort to derail his political career and sway the upcoming presidential election. He also alleged that President Biden was using the Department of Justice, along with a former prosecutor who joined the Manhattan District Attorney’s office, to target him.
