Hunter Biden has officially filed a lawsuit against Fox News over allegations of broadcasting nude images of him without his consent.
The lawsuit claims that Fox News engaged in “revenge porn” by airing intimate photos as part of a series titled “The Trial of Hunter Biden” on its streaming service, Fox Nation. According to the lawsuit, lawyers for Biden argue that the network violated New York’s revenge-porn statute, which prohibits the publication of intimate images without consent.
Lawyers for Biden argued that “In addition to the unlawful commercial exploitation of Mr. Biden’s image, name, and likeness, ‘The Trial of Hunter Biden’ unlawfully publishes numerous intimate images (both still and video) of Mr. Biden depicting him in the nude, depicting an unclothed or exposed intimate part of him, as well as engaged in sex acts.” It further alleges that Fox disseminated these images to “humiliate” and “tarnish” Biden’s reputation.
In response, Fox News has dismissed the lawsuit as baseless and politically motivated. In a statement, the network said, “The core complaint stems from a 2022 streaming program that Mr. Biden did not complain about until sending a letter in late April 2024. The program was removed within days of the letter, in an abundance of caution, but Hunter Biden is a public figure who has been the subject of multiple investigations and is now a convicted felon. Consistent with the First Amendment, FOX News has accurately covered the newsworthy events of Mr. Biden’s own making, and we look forward to vindicating our rights in court.”
Fox aired the controversial program in October 2022 but removed it earlier this year following a legal threat from Biden. Despite this, the lawsuit notes that promotional materials and clips from the series remain accessible online, including on third-party streaming platforms.
Hunter Biden’s lawsuit seeks punitive damages and the profits Fox earned from the series. Biden’s lawyers argue that the series was not a genuine “news event” but a fictionalized portrayal created “for trade and advertising, and merely exploits Mr. Biden’s name, image, and likeness for Fox’s commercial benefit.”
