A top US Senator has called on cabinet members of the Biden administration to invoke the 25th Amendment to potentially remove him from office.
Sen. Thom Tillis (R-NC), part of Senate Minority Leader Mitch McConnell’s (R-KY) leadership team, urged President Biden’s Cabinet to consider the 25th Amendment following Biden’s debate performance, which raised bipartisan concerns. Tillis emphasized that the debate between Biden and former President Trump necessitates a discussion on Biden’s capability to serve. He suggested that if Biden does not voluntarily step aside, the Cabinet should act.

In his letter to republican members, Senator Tillis wrote, “If Biden cannot speak coherently, articulate his policies, and is unfit to perform after weeks of preparation, how will he perform when America is truly tested by a national security crisis, the kind of historic, high-stakes test his predecessors have been confronted with? I believe Biden is a decent man who cares about the country. However, time catches up with everyone, and it’s clear his decline is more dire than people realized and the White House has not been as truthful nor transparent as it should have been. If he is unaware of his own unfitness to continue serving, the Biden cabinet should consider invoking the 25th Amendment, in which the cabinet can vote to transfer powers and authorities from the President to the Vice President.”

Tillis’s call marks the first senator to make such a call post-debate. House Speaker Mike Johnson (R-LA) also suggested the Cabinet consider the 25th Amendment without fully endorsing Tillis’s position.
Despite these calls, Biden’s campaign continued to operate as usual, with President Biden vowing to stay in the election at a rally in North Carolina Friday. President Biden said, “Folks, I don’t walk as easy as I used to. I don’t speak as smoothly as I used to. I don’t debate as well as I used to. But I know what I do know. I know how to tell the truth. I know right from wrong. And I know how to do this job. I know how to get things done. And I know what millions of Americans know: When you get knocked down, you get back up.”

The 25th Amendment enables the vice president and a majority of the executive Cabinet to declare the President unfit to carry out his duties, thereby transferring power to the vice president. If contested, Congress would require a two-thirds vote in both the Senate and the House to affirm the decision.
