Texas Attorney General Ken Paxton has filed another lawsuit against TikTok, accusing the company of unlawfully collecting and selling minors’ personal information without parental approval.

What’s the deal: In the lawsuit, Attorney General Paxton claims that TikTok knowingly violated the Securing Children Online through Parental Empowerment Act by collecting, sharing, and selling minors’ personal information without obtaining the required parental consent. The lawsuit claims that TikTok’s “family pairing feature does not comply with Texas law, as it lacks adequate parental identity verification and requires the minor’s approval to link accounts.

Additional allegations: Paxton’s lawsuit also claims that TikTok is illegally sharing minors’ data with third parties, such as advertisers, and targeting known minors with advertisements.

Statement from AG: In a statement, Paxton said, “I will continue to hold TikTok and other Big Tech companies accountable for exploiting Texas children and failing to prioritize minors’ online safety and privacy. Texas law requires social media companies to take steps to protect kids online and requires them to provide parents with tools to do the same. TikTok and other social media companies cannot ignore their duties under Texas law.”

Paxton’s lawsuit is seeking $10,000 per violation plus attorney fees.
