The Supreme Court has greenlit the Trump administration’s move to revoke Temporary Protected Status (TPS) for approximately 350,000 Venezuelan migrants.
Some shit you should know before you read: Back when President Biden was in office, his administration granted Temporary Protected Status (TPS) to Venezuelans in 2021, citing the country’s deepening humanitarian crisis marked by political repression, economic collapse, and widespread shortages of basic necessities. The designation allowed Venezuelans already residing in the US to remain legally and obtain work permits, as conditions in Venezuela were deemed unsafe for return. In February, Homeland Security Secretary Kristi Noem moved to revoke the Biden-era TPS extension from 2023, arguing it was “contrary to the national interest” and claimed that the program had enabled gang members, terrorists, and criminals to remain in the country. Ultimately, civil rights groups sued to block the Trump administration from revoking TPS protections for them, which eventually made its way to the Supreme Court.

What’s going on now: In a notable development, the Supreme Court sided with the Trump administration in revoking TPS for nearly 350,000 Venezuelan migrants. The decision lifted a lower court injunction that had previously blocked the termination of TPS protections granted under the Biden administration.
The justices did not disclose how each member voted, except for Justice Ketanji Brown Jackson, who publicly dissented and stated she would have denied the administration’s request.
The Supreme Court’s decision now places hundreds of thousands of Venezuelans at risk of deportation, with uncertain legal pathways remaining.
In a statement, a DHS spokeswoman called the ruling a “win for the American people and the safety of our communities.” She added, “The Biden administration exploited parole programs to let poorly vetted migrants into this country — from MS-13 gang members to known terrorists and murderers. The Trump administration is reinstituting integrity into our immigration system to keep our homeland and its people safe.”
